Read the Bill Legislation Back

In Michael Moore's "Fahrenheit 9/11" Rep. John Conyers makes a stunning admission that is actually a widely known fact in Washington. Conyers states that no member of Congress read the Patriot Act before voting for it. In fact most bills aren't read by congressmen or their staff because they aren't released in a timely fashion. Just as stunning to the public, and to many members of Congress, was the outcome of the fight over the 2003 Medicare bill. The bill was introduced moments before an all-night session, preventing legislators from being able to read the bill. The bill passed with most members having no idea of the provisions slipped into the bill and no one knowing the true final cost. More recently, liberal and conservative bloggers have raised the issue of prompt bill release over the immigration bill and free trade agreements.

Just last week, Rep. Brian Baird (D-WA) introduced H. Res. 504, which would require all bills to be posted online 72 hours before they are voted on floor debate begins. This bill would greatly alter the dynamic by which bills are considered in the House. Passage of H. Res. 504 would mean that each piece of legislation will receive greater citizen input and greater scrutiny from the media and from legislators themselves. This bill is an essential piece to changing the way business is done in Washington and changing the dynamic between citizens and their representatives. Last year the bill (then H. Finding Bills Online

It would be nice to know why the Government Printing Office takes so long to take a bill and put it online so that I can access it on Thomas. Yesterday, I tried to read the lobbying and ethics reform bill currently being debated on the Senate floor, bill number S. 1, and found that it was not online at Thomas because it takes a day or two for the GPO to print a bill. Of course, S. 1 was introduced last week but the GPO says that it might take longer when a lot of bills are introduced at once (members of the House introduced over 300 bills last week, Senators introduced over 100). Is there some actual explanation for this delay other than aimless bureaucracy and backwards computer technology. If I had just drafted a bill I could post the entire thing on this blog right now, but for some reason Members of Congress cannot post bills immediately online?

Not Shutting Down Quite Yet

Not everyone is quite ready to gear down for the long July 4th weekend. Our colleagues in Montana at the Institute on State Money and Politics, for example, just published their first newsletter. Check it out here.

The Institute -- also known as the DataShaq -- is a nonprofit, nonpartisan organization that compiles and analyzes campaign contribution reports for state-level candidates, political party committees and ballot issue committees. Their database of more than 15 million records is available on their Website, and is easily searchable within a given state and election year, as well as across the 50 states and multiple election cycles. It provides a wealth of information on the forces behind campaign contributions and public-policy discussions in the states. If you don't know their work, and are involved in state-based advocacy, you should. Greg Elin, who heads the Sunlight Labs, has been working with them for most of this week to develop their first APIs. Sounds like that work has gone extremely well.

  • The Washington Post and The Hill finally run stories on [sw: Dennis Hastert]'s land deal in Kendall County, Illinois. The Post story looks at Hastert's land deal along side the land deals of Reps. [sw: Ken Calvert] (R-Calif.) and [sw: Gary Miller] (R-Calif.). Both Calvert and Miller made large sums of money off of land that they helped, through the earmarking process, become more profitable. Their stories are here and here respectively.
  • New tax records show that Rep. [sw: Alan Mollohan] (D-W.Va.) steered $179 million in federal earmarks to companies that contributed to charities that he is associated with. According to Bloomberg, "The money went to 21 companies and nonprofit groups that contributed $225,427 to the Robert H. Mollohan Family Charitable Foundation in 2004 -- almost half of the charity's revenue". Charities connected to politicians (or spouses of politicians) are a way for companies and interests to curry favor from a legislator out of the public eye. Numerous lawmakers have used their charities inappropriately including Senators Rick Santorum (R-Penn.) and Bill Frist (R-Tenn.). I'm sure that there are many more political charity abuses that go unnoticed.
  • The Senate Indian Affairs Committee just released their final report on the Jack Abramoff tribal scandal, "Gimme Five -- Investigation of Tribal Lobbying Matters". The Arizona Republic reported this morning that the report is expected to "read more like a summer mystery novel with chapters missing than a tell-all account of former GOP lobbyist Jack Abramoff's corrupt influence in Washington." Since Committee Chairman John McCain (R-Ariz.) refused to call members of Congress to testify before his committee those "missing chapters" will have to be filled in by the Justice Department and our courts.
  • Most members of Congress do not read the bills that they vote on. Rep. [sw: John McHugh] (R-N.Y.), the chairman of the House Armed Services Committee personnel subcommittee, did not know that a provision existed in a bill that he crafted that he "philosophically" opposed. Oops. Maybe we should pay attention next time. Or we could make bills available 72 hours before they are voted on (as Readthebill.org is pushing) so that maybe somebody else could have caught what John McHugh didn't.

Mo’ Money

At the end of last week the Sunlight Foundation made a number of new grants. We're really excited about the potential of each of them.

The work of ReadtheBill.org (which I've talked about before) is a hugely important effort. It could end the practice of ramming bills through Congress in the dark of night -- bills that are filled with favors for special interests, earmarks, and heaven only knows ((truly) what else. And think of what activists can cook up (particularly online) if they have 72 hours to read legislation and get citizens to weigh in. We think that ReadtheBill.org will make a huge difference in making Congress' work more transparent and in engaging citizens.

Good Stuff

Posting's been light this week. I spent a few days in New York meeting with other funders (JEHT Foundation and Open Society Institute), brainstorming with our far-flung staff and consultants (a virtual workplace is good, but sometimes you just have to meet face-to-face!), and talking with groups about their work. I've also been doing interviewing for new staff.

I'm quite fascinated by several groups' work that we've looked at recently. Rafael DeGennaro has created a potentially powerful populist movement over the simple notion that lawmakers ought to actually read a bill before they vote on it. His ReadtheBill.org (BTW you can find him at the YearKos convention this week), presents a positive agenda -- every piece of legislation must be posted for 72 hours before it's voted on --  that will enable citizens, activists, journalists, indeed everyone, to know more about what is going on in Congress and to express their opinions about it. Certainly one of Sunlight's goals is to not only make information available, but also to make it available in "real time" so that democracy is enlivened by civic engagement. Seems to us that DeGennaro has singled out a pretty basic element to making that happen. Following his "Mystery Bills" feature is a must.
