The first thing to admit is that the title of this post might be a bit misleading. While in the last few months Sunlight was indeed busy researching procurement transparency on many different levels, we’ve never had the intention (or the power) to do holistic international research on procurement transparency, nor did we want to rank countries based on their performance. This would have been an endless - and probably pointless - effort. Our motive behind mapping the global landscape of procurement disclosure trends was to find best practices, powerful online tools and also to gain inspiration for Sunlight’s recently released open data guidelines for procurements.
Continue readingWhy Kenya’s open data portal is failing – and why it can still succeed
Kenya’s open data portal is floundering. Despite the excitement that surrounded its launch in July 2011, the portal has not been updated in eight months, has seen stagnant traffic, and is quickly losing its status as the symbolic leader of open government in Africa. For a number of reasons, the portal, which runs on a Socrata platform and can be viewed here, has not lived up to the often sky-high expectations of many onlookers. First, government ministries have been reluctant to release data. Many observers expected that the launch of the portal would help eradicate the Kenyan government’s harmful culture of secrecy. The Official Secrets Act, a holdover from the colonial era that prevents government employees from sharing official information, has created a closed culture in government and has starved the portal of much needed information. Second, implementation of the new constitution has hamstrung government officials who are trying to adjust to new roles and identify new responsibilities, significantly reducing government officials’ ability to incorporate open data into their already overburdened workstreams. The new Kenyan constitution, which was overwhelmingly passed in a 2010 referendum, created a new devolved system of government. Large changes are still being implemented, and government officials are struggling to adjust. This inexhaustive list displays some of the large obstacles standing between the open data portal and the goals of a more transparent, accountable, and effective government. Despite these challenges, there is still hope that Kenya’s open data experiment can regain its footing and reestablish itself as an open government leader.

A heated debate over proposed lobbying legislation is underway in Great Britain, where lobbying reform legislation has been offered as a result of a scandal in which Members of the House of Lords apparently offered assistance to fake solar energy lobbyists in exchange for payment. Prime Minister David Cameron proposed lobbying reform legislation in 2010, but it took the scandal to muster enough outrage to spawn reform efforts. Much of the outcry over the bill is focused on provisions that would limit the amount of money third parties could spend on elections. But even more fundamentally, the bill fails to do what it set out to do—that is, shine a light on the activities of lobbyists. The bill is so poorly and narrowly crafted that it may result in less transparency than is currently provided by the UK’s voluntary (and woefully incomplete) lobbyist registry.

As a member of the Open Government Partnership Steering Committee, the Philippines is uniquely positioned to be a highly visible leader on open government. However, the legislature’s failure to pass a freedom of the information bill has brought this role into question. So, what’s going on in the Philippines? In the parliament, bills on internet freedom, legislative crowdsourcing, and parliamentary openness have all been introduced this summer. The other branches of government are also turning increasingly towards technology to improve governance. All this suggests that the Philippines’ role as an open government leader may be back on track, but only if this summer’s promising work is sustained.

The key to practical democracy is the active involvement of citizens in every aspect of governance; and budget as an imperative instrument of governance is no exception. However, the budget-making process in Pakistan has been closed and largely opaque and people in general have little opportunity to participate in the process that affects the quality of their lives directly.
In recent decades budget transparency has become a pillar of good governance around the world, but in Pakistan a lot of work still needs to be done. The budget making process in Pakistan is wrapped in curtains of secrecy, as both the government and political parties are taking no major steps to make this process participatory or peoples oriented.
The Centre for Peace and Development Initiatives (CPDI), an Islamabad-based think tank, conducted a study to monitor the process of budget making at the district level. The main aim of this study was to collect research based evidence and find out whether the district governments of Punjab are following the timelines and required procedures for the budget making process. The District Government Budget Rules 2003 lay a clear outline for different timelines and procedures to follow, including a clear requirement for people’s participation in the budget making process.
The survey results revealed very disturbing trends in budget formulation.
Continue readingTransparency Case Study: Public Procurement in the Slovak Republic
Introduction
Transparency and open data policies and initiatives have reached a state of maturity where it is crucial for us to evaluate them to learn what works, what doesn’t and why. Transparency is not likely to be a cure-all, but we think it is a cure-some; so, we need to figure out where and how it should be best applied. As part of that process, we have been conducting a series of in-depth case studies on the impact of technology enabled transparency policies around the world. Our initial case studies look at transparency in public procurement and we have chosen four countries to study. This analysis discusses our findings about public procurement disclosure by the Slovakian government.
For the Slovakian case study, we conducted interviews or sent questionnaires and surveys to members of the following groups: members of transparency NGOs, journalists who have covered procurement, academic researchers, the Slovakian Government Office of Public Procurement and the Slovakian Business Alliance. The experiences of these diverse respondents have allowed us to develop an equally diverse and comprehensive picture of the impact of the public procurement reforms enacted in Slovakia over recent years.
Our major findings: Slovakians' increased access to public data has led to increased oversight and engagement by the civil sector and the public. However, because of a lack of enforcement, corruption in public procurement remains a significant problem.
Continue readingCrowdsourcing to Fight Corruption: Aleksei Navalny and the RosPil Experiment
A few weeks ago, Russia’s most popular and controversial opposition figure, anti-corruption activist Aleksei Navalny, was tossed in prison on charges of conspiring to steal money from a state owned lumber corporation -- only to be set free less than a day later pending action from a higher court. The shocking turn of events has once again thrust Navalny and his campaign against public sector corruption into the global limelight. While Navalny’s legal future may occupy the headlines, we wanted to focus on Navalny’s anti-corruption website RosPil, a state procurement monitoring site where troves of government contracts and tenders are scrutinized by eager volunteers searching for signs of corruption.
Corruption is an enormous political and economic problem in Russia. Most of the corruption, which effectively cuts the country’s growth rate in half according to economists Sergey Guriyev and Oleg Tsyvinsky, is tied up in the government's procurement system. Former President Medvedev’s administration suggested that upwards of 1 trillion rubles are embezzled through the state acquisition process every year. It is this rampant corruption that Aleksei Navalny, who is well known for his brand of tech-empowered protest, is trying to stamp out. Unfortunately, a vital piece of the transparency agenda--party and campaign funding--remain depressingly opaque. Because the financing behind how candidates and parties come to power influence later policy and spending decisions, it is critical that countries address political finance transparency. Sunlight is committed to create a strong base for reform by combining our efforts with other activists and sharing our expertise in a meaningful way.

In advocacy, knowing who your friends are is half the battle. With this in mind, Sunlight Foundation has gone about compiling and curating a list of international organizations working on open government issues in their own countries or regions, an effort that brings a touch of clarity to an unwieldy transparency ecosystem. The spreadsheet can be viewed here and any organization or project that is missing from the list is encouraged to fill out this brief survey. While Sunlight may be taking the lead here, we see this as a project that is by the community and for the community -- so please contribute!
After several months of gathering information from transparency-related organizations, our repository was made public in late May and was received with enthusiasm by many members of the community. Since its launch, over 40 organizations from every corner of the globe have requested that their work be included. We were happy to add them to the list and are excited to continue to hear from new organizations and new projects. We know there are a number of groups doing incredible work that are still not included on this list and we hope to hear from those organizations very soon.

Fabrizio Scrollini is currently working on a PhD on transparency and accountability in Latin America at the London School of Economics and Political Science. He co-founded DATAuy which supports Quesabes -- the first website in Uruguay that helps citizens request for public information from their government. DATAuy has also championed open government, open parliament, and transparency in Uruguay by collaborating with other NGOs in the region and organizing hackathons. Two weeks ago Uruguay, a small Latin American country, had the pleasure of hosting open data and transparency activists from different corners of Latin America and the world for the first Latin American open data unconference. ABRELATAM (named after a plan on the Spanish word “abrelatas,” which means can opener), was organized by DATA Uruguay and Ciudadano Inteligente from Chile in a pioneer partnership to advance transparency and open data in the region. In this post I would like to share with you a snapshot of the awesome discussions that took place at the ABRELATAM. Community matters. This is hardly a surprise but community can mean different things. Indeed people are interested in open data for all sorts of reasons, but when it comes to a particular area or group of datasets, and the aim is social change, the need for different skills and common goals becomes crucial. Some of the greatest sessions were about how to link the different worlds of technology, communication, policy and social problem solving. Open data (or the lack of it) is sometimes a great excuse to put minds together working to achieve better outcomes. People working together (not just data) will deliver change, and this is done online, but offline engagement is crucial as well. Communities need to be expanded to involve more people and organizations who can also help to promote open data and use it for their own ends.
