New Louisville Open Data Policy Insists Open By Default is the Future

On Tuesday, October 15, 2013, Louisville Mayor Greg Fischer announced the signing of an open data policy executive order in conjunction with his compelling talk at the 2013 Code for America Summit. In nonchalant cadence, the mayor announced his support for complete information disclosure by declaring, "It's data, man." What's more is this was one of three open data policies signed into law over the last week, the others being California’s West Sacramento and Oakland policies. The Louisville policy is unique in that hits many of the Sunlight Foundation's Open Data Policy Guidelines rarely touched upon by others, including a strong "open by default" provision, and, like South Bend, IN, roots its basis for affecting the transparency of information disclosure firmly in legal precedent, in this case, the Kentucky Open Meetings and Open Records Act. Doing so further empowers it's "open by default" status. The Louisville policy also provides a clear series of checks and balances to insure information is disclosed by calling for (1) the creation of a comprehensive inventory supported by the letter of the law itself (which we have only seen in the 2013 U.S. federal policy thus far — and which has not yet been implemented), (2) a yearly open data report, and (3) built-in review of the policy itself for the ever-changing information and technology landscape ahead. Ted Cruz Moves on from Trying to Defund Obamacare to Defending Dark Money

Ted_Cruz,_official_portrait,_113th_CongressTed Cruz’s (R-TX) mission to shutter the government in one fell swoop may be (temporarily) over, but that doesn’t mean he’s stopped trying to handcuff federal agencies in an effort to impose his own agenda on their work. His most recent effort involves preventing a Senate vote on the nomination of Tom Wheeler for FCC chairman because he wants to get Wheeler’s commitment that he will not use the FCC’s regulatory authority to require disclosure of the dark money behind political ads. In a statement, Senator Cruz’s office announced, “Yes, the Senator is holding the nominee until he gets answers to his questions regarding Mr. Wheeler’s views on whether the FCC has the authority or intent to implement the requirements of the failed Congressional DISCLOSE Act. Mr. Wheeler had previously declined to give specific answers, but as he’s now expressed his readiness to revisit the Senator’s questions, the Senator hopes to communicate with him soon.” Good luck to Mr. Wheeler during that conversation.

winnerLast week we celebrated our billionth API call by announcing a giveaway, and Tuesday we went ahead and pulled the name of a random API user who had made at least one successful query. I've been emailing with him since, and am please so say that Matt Gabrenya is our winner! You can find his Github profile here, and his business site, Boston TechCollective, here. Matt used our APIs to power his BillTrack project, which aims to make it easier to run advocacy campaigns on issues like SOPA and the Keystone XL pipeline. We're delighted that Matt found our APIs useful, and thrilled that thousands of you have as well. We're going to keep making them better, deeper and more powerful; we're counting on all of you to put them to good use.

Quién Manda: Who’s the Boss? – Spain Edition (Now with less Tony Danza)

quien-manda_logoLaunched last week by Madrid based nonprofit, Civio, Quién Manda (Who Rules?) takes on the task of monitoring the goings on of Spanish public officials and influential corporate leaders. The platform has been designed to keep an eye on the unmonitored, and rarely recorded interactions that Spanish politicians are having behind closed doors, tinted car windows and somehow frequently right in front of the lens of a camera. The team at Civio has tasked themselves with tagging photos a la Facebook with as many high profile names as they can. Each individual and corporation that gets tagged receives a profile that collects all tagged photos and displays the power connections that have been identified, along with links to social media accounts and any available biographical information. The system currently has over 100 tagged photographs, identifying over 2500 relationships.

OGP: Opportunities and Limitations

OGP2It’s been two years since the Open Government Partnership (OGP) was first announced. As Sunlight shares recommendations for the US’s OGP National Action Plan, we’re looking forward to attending and participating in the upcoming summit in London. OGP has demonstrated explosive growth, with the initial 8 founding countries expanding to 60 in a very short time, and more likely to be announced soon. This rapid expansion is an affirmation of government officials’ desire to grapple with transparency issues, and demonstrates an appetite -- particularly from the public --  for “open government” and making it more accessible to the people it serves. OGP has been important in helping governments move in that direction, particularly Brazil’s passing a new FOI law and the US committing to implement the EITI. OGP itself has been quite open in discussing its limitations, and no doubt there will be more of that at the next meeting. But it’s important, in advance of the upcoming summit, to offer a few observations about OGP’s structural limitations to provide context for the new national action plans.

Suggestions for the OGP National Action Plan

The Obama Administration is expected to release the second version of its Open Government Partnership National Action Plan this fall.  The Open Government Partnership (OGP) is the primary multi-national initiative for open government, founded in 2011. The original US plan, released on September 20, 2011, covered a lot of ground, but also suffered a lack of detail and ignored several of the most pressing transparency issues. (Both money in politics and national security went uncovered.)

Given the US’s leadership role in the world (and in OGP), and the variety of issues the country faces, we hope the US National Action Plan will demonstrate how an administration can use transparency reform to help address some of the most fundamental challenges it faces.

The following are four Sunlight priorities for the upcoming US National Action Plan, and are priorities that we’ve often repeated to White House officials in our work.
